The details of a High Court writ have revealed that a man is suing Network Rail for £250,000 over the deaths of his wife and grandson.
Jean Hoggart, 56, and Mikey Dawson, seven, were killed while passing over railway lines at a level crossing in Nottinghamshire's Bestwood in November 2008.
Although they had waited for a tram to pass, they did not hear or see the train that followed it immediately afterwards and stepped out in front of it.
Widower Laurence Hoggart, 54, is suing Network Rail for £250,000 for alleged safety failures and negligence, according to the Telegraph.
He claims that the company - which has a responsibility for the crossing's upkeep - failed to keep it properly lit and did not provide signs to warn pedestrians when trains were coming.
Mr Hoggart also cited a 2004 risk assessment that recommended straightening that section of the train line for better visibility, which had not been followed up.
A spokesperson for Network Rail declined to comment.
Statistics from the organisation show there were 13 deaths on level crossings during 2009 and 14 the year before.
