The Compensation Act 2007 may help those who have contracted mesothelioma, cancer of the lining of the lung, in their claims for compensation. The Act reversed a House of Lords decision so that someone with mesothelioma can claim all of their compensation from any of his or her employers.
The Compensation Act 2007 may help those who have contracted mesothelioma, cancer of the lining of the lung, in their claims for compensation. The Act reversed a House of Lords decision so that someone with mesothelioma can claim all of their compensation from any of his or her employers. Previously, the claim would have been divided between the various employers.
The Government proposed to extend and speed up the process of claiming industrial injuries disablement benefit and pneumoconiosis panel payments. Before, this was only available to people who were exposed to asbestos at work. Now, people who have been exposed to excessive amounts of asbestos in the environment, or through contact with others' work clothes, can apply for the benefit. The Association of British Insurers is going to change the way that employers' insurance policies are tracked down. The end result is that many more sufferers whose employers are no longer in business should be able to bring a claim.
Those who have developed pleural plaques, the markings on the lining of the lung caused by asbestos exposure, are still waiting for a House of Lords decision about whether they can continue with their claim. The hearing is expected in July 2007. |
