Court rejects plea for divorce settlement renegotiation |
A divorced woman has failed in her attempt to have her settlement renegotiated.
The value of the assets owned by Kim Walkden's former husband Martin increased substantially when it was valued at £3.8 million in a takeover deal in 2006.
However, the divorce settlement she was offered months earlier was based on a valuation of £800,000.
Mrs Walkden therefore sought a renegotiation of the amount she was entitled to, after originally being awarded £482,000 and monthly maintenance of £1,100. Lord Justice Wall, the presiding judge, rejected her appeal and backed Mr Walkden's solicitor's view that the dispute was the reverse of the recent Myerson versus Myerson case.
In the earlier case, Brian Myerson had tried and failed to renegotiate for a smaller divorce settlement for his estranged wife on the grounds that his finances had been adversely affected by the recession.
This comes after figures from Aviva showed that more than half of divorcing couples would like to see divorce laws amended to provide them with greater protection.
