Mediation required for divorced couples before courts |
Married couples who are seeking help from divorce lawyers are going to have to attend mediation sessions before going to court.
From April 6th 2011, husbands and wives will be asked to take part in these sessions in order to solve disputes if they cannot agree on how to share their assets and custody over their children.
The decision was made by judges and the Ministry of Justice to reduce the strain on the system, as a result of many divorced couples taking their cases straight to court.
Justice minister Jonathan Djanogly said: "Mediation is a quicker, cheaper and more amicable alternative, particularly where children are concerned."
This will also reduce the period it takes for a divorce to go through, as the average time for a case using meditation to be finalised is 110 days, in comparison with 435 for those taken to court.
Couples considering a divorce were recently advised by Linda Lee, president of the Law Society, to use an accredited family law solicitor, telling the Guardian that even straightforward separation cases can get complicated.
