Family law judge calls for more rights for cohabiting couples |
A top family law judge has said that cohabiting couples should have more rights over property and assets when they split up.
President of the High Court Family Division Sir Nicholas Wall told the Times that the current regulations put women in particular at a severe disadvantage, because they are unable to claim maintenance as divorcees would.
Contrary to popular belief, there is no such thing as a 'common law spouse' in the eyes of the law and couples often see their property divided unfairly in court, no matter how much each party has contributed, Sir Nicholas said.
"I am in favour of cohabitees having rights because of the injustice of the present situation," he commented, adding that he is "disappointed" with the government for not having already implemented them.
This comes after Faith Glasgow of Money Observer, writing for Interactive Investor, recently called for cohabiting couples to have Wills drawn up. She pointed out that they will otherwise have no automatic inheritance rights if one of them dies intestate.
