New Rights for Cohabitees |
Sir Nicholas Wall, the country's most senior family judge, has given his support to the idea that unmarried couples should be given legal rights. Like many family lawyers he believes that the law should be changed to give greater protection to cohabiting couples. Mary Pearce, who heads the family law team at Kester Cunningham John, comments: "We would endorse his views. The current system often results in an unfair outcome when a relationship breaks down, and potentially to even greater problems if one partner dies and has not made a Will. Until there is a change in the law the most sensible thing for people to do when they choose to live together is to make both a Cohabitation Agreement and a Will; this will give them the best possible control over the future of their joint assets.
