Supreme Court rules in favour of Pre-Nuptial Agreement |
The Supreme Court has this morning potentially paved the way for pre-nuptial agreements to become enforceable in the UK by recognising that Nicolas Granatino should be held to the terms of the pre-nuptial agreement made between he and Katrin Radmacher.

"While the circumstances of this particular case were unusual, the Supreme Court's ruling takes us a stage further down the path towards pre-nuptial agreements being legally enforceable in England, as they already are in many parts of Western Europe and the US.
The move will be welcomed by many who feel that if intelligent couples wish to set up these agreements, the courts should not be able to interfere. We are seeing more people who want to enter into pre-nuptial agreements, especially those with assets who have been divorced and are now planning to re-marry. This rulilng will give them more confidence that what they are doing will be recognised by the Court, but new legislation will be required for pre-nuptial agreements to be recognised formally and this will take rather longer."
