Mediation 'could become compulsory' in divorce process |
Thousands of couples seeking a divorce could be legally required to go through mediation under new proposals put forward by the government.
A plan to be published at the start of next year will recommend that a compulsory mediation stage should be introduced before financial or custodial disputes come before the courts.
Head of the review David Norgrove said he hopes this will ease the "tremendous strain" family law courts are currently under.
He pointed out that nine out of ten cases could be handled by lawyers outside court, commenting: "If you can get both parties to learn about mediation, the great majority will go on to use it."
Family law solicitors at Kester Cunningham John will be able to advise anyone considering a divorce on the different ways of approaching it, including whether the collaborative law process is suitable. The details will depend on the individual and their requirements.
