US lawyer speculates on possible Cox-Arquette divorce outcome |
A US lawyer has been speculating on the financial outcome of a possible divorce between Courtney Cox and David Arquette.
Speaking to E! Online after the Hollywood couple announced their separation earlier this week, Robert Brandt said it is likely that a pre-nuptial agreement was signed before their marriage 11 years ago.
Under California law, anything earned by either party during a union belongs equally to them both, but with Cox having amassed a significantly larger fortune than Arquette due to Friends, Mr Brandt said it is likely she would want to protect it with a pre-nup.
However, the expert also said it is unlikely that the less famous spouse would walk away with nothing in the event of a divorce.
"If that were the case, the pre-nup could get thrown out in the courts for being unfair or unconscionable when it comes time to enforce it," he pointed out.
Mr Brandt suggested that a cash payout or a monthly sum of around 20 per cent of Cox's wealth could be paid to Arquette should they officially split.
Pre-nups are not currently binding in the UK, but legal experts have suggested they may be in the near future to put Britain in line with the US.
Meanwhile, it was also announced this week that Christina Aguilera has separated from her husband of five years Jordan Bratman.
