Judges 'are becoming more willing to consider pre-nuptial agreements' |
Pre-nuptial agreements are increasingly being taken into consideration by UK courts, despite not yet being legally binding.
This is according to Jill Goldman, a family law expert, who said in an interview with MoneyWise.co.uk that many judges are now willing to use pre-nups as long as they are properly drawn-up and not outlandish.
She explained: "It is a statement of intent. They can be overturned and a judge might throw out some of the clauses, but they are becoming more watertight."
In order to ensure pre-nups stand up in a divorce court, Ms Goldman said each party must seek independent legal advice at least three weeks before the ceremony.
She also suggested it may be best to agree to a one-off settlement in case of a divorce, rather than ongoing maintenance payments.
It has recently been reported that both Robbie Williams and Hilary Duff signed pre-nuptial agreements ahead of their respective weddings earlier this month.
