Court rules covertly obtained divorce documents to be unlawful |
In a landmark ruling that could affect high-profile divorce cases in the UK, a judge has deemed documents obtained secretly by battling spouses trying to prove hidden assets to be unlawful.
Previously, when people found information which proved that their estranged spouse was hiding their assets to prevent them being divided up equally, it was permissible for the incriminating documents to he held up in court.
This fell under a protection called the Hildebrand rules and was often used in multi-million pound divorce cases.
However, during the current 'Del Monte' divorce case, Lord Neuberger said this is effectively a breach of confidentiality.
The ruling centres around the separation of Lisa Tchenguiz Imerman and her husband Vivian, who parted in 2008.
