Woman wins divorce settlement 25 years on |
A woman who went to the Court of Appeal to argue that she should be entitled to continued maintenance payments from her ex-husband has been successful in her legal battle.
Philippa Vaughan, 66, and David Vaughan divorced in 1985 after 18 years together, but Mr Vaughan had been paying his ex-wife £27,000 a year until 2009.
A court ruled last year that these maintenance payouts should cease, but Ms Vaughan argued that this was unfair and would leave her facing undue financial hardship.
This week, Lord Justice Wilson has ruled in favour of Ms Vaughan, who will now receive a lump sum payout of £215,000.
The judge commented that it had been "plainly wrong" for the previous court to reduce her income in this way.
"I am relieved that finally justice has prevailed. Court orders and first wives cannot be swept aside at the whim of the rich and powerful," Ms Vaughan said outside court.
Her ex-husband had argued in February 2010 that he should not have to pay Ms Vaughan, as much of his wealth comes from his second marriage, but this was dismissed.
