Divorce should be made easier, say family law specialists |
Family law solicitors have recommended that the divorce process be made more straightforward in order to help couples to avoid bitter and stressful court battles.
A survey conducted by TakeLegalAdvice.com has revealed that three-quarters of the UK's top lawyers wish to see the country's antiquated fault-based divorce system undergo major reform.
Although none of the major political parties are currently supporting this reform, family law experts feel that ending this policy will make the process less acrimonious and help to prevent cases from going court.
Under the current system, couples are legally required to prove unreasonable behaviour before they are allowed to undergo a separation, as there is no option for marriages to be dissolved by mutual consent.
Family law association Resolution has criticised this state of affairs, saying it "simply adds animosity and more heartache to an already distressing process".
Earlier this week, the Law Society reminded those going through a divorce that they should consult a lawyer as soon as possible in order to avoid potential legal complications and pitfalls.
