Legal advice on divorce 'is essential for older people' |
Retired couples who are going through a separation have been called upon to ensure they consult their solicitors for professional advice.
The Law Society has stated that older people who seek legal guidance over financial issues on divorce are less likely to have to go through a lengthy a stressful court process.
This advice comes in response to recent increases in the divorce rate among over 60s, which is leaving many retirees facing complex separation proceedings to divide up large estates and pension funds.
According to the body, seeking counsel from lawyers will allow older people to pursue more amicable means of resolution such as mediation and collaborative law, thereby reducing the upset caused by the process.
Robert Heslett, president of the Law Society, said: "A solicitor is the only professional who has the qualifications and foresight to work towards a fair settlement in complex divorce cases."
Last month, the Legal Services Commission proposed a scheme to allow families eligible for legal aid to pursue the option of collaborative law when divorcing.
