Pre-nuptial agreements 'playing a bigger role in family law' |
Pre-nuptial agreements are becoming an increasingly important part of family law relating to divorce, according to an expert.
Legal education specialist BPP Law School has stated that courts are beginning to consider such arrangements to be a major factor when calculating financial settlements during a separation.
Alison Wells, programme director of the school's legal practice course, suggested that this may lead to the agreements being made legally binding in the next few years.
The increasingly large role played by pre-nups was also highlighted by a recent BBC interview with David Allison of family law group Resolution, who stated that the number of agreements signed has increased "tenfold" recently.
Ms Wells therefore recommended that couples seek to take pre-nuptial advice in order to make any potential divorce proceedings as stress-free as possible.
She said: "The pre-nup may well serve to be effective in the sense that for some parties it reduces the cost of litigation and the animosity surrounding divorce."
