Mediation 'gaining increasing importance in divorce law' |
Couples going through divorce have been advised of the increasingly large emphasis being placed on mediation in family law.
A new report in the Times has stated that divorce mediation through a family lawyer or collaborative law is becoming seen as a preferable alternative to going through the courts.
This is due to the reduced financial and emotional burden caused by an out-of-court discussion, which can be particularly beneficial when child-related issues are involved.
The rising importance of mediation was underscored recently by a proposal by justice minister Bridget Prentice, which called for consideration of the process to become compulsory for all couples going through a separation.
Legal experts have backed the suggestion, with Sarah Lloyd of the family law group Resolution suggesting that it would help people to find a solution which is "best suited to them".
This comes after BPP Law School last week highlighted pre-nuptial agreements as another means of making a divorce process as civil and efficient as possible.
