Robert Gair who specialises in Brain Injury cases, rehabilitation, and compensation looks at why you need a lawyer when you or a family member have sustained a Brain Injury.
If you or a loved one has been involved in an accident, and someone else is to blame, then you are entitled to seek redress. Usually that involves an insurance company. Insurance companies deal with accidents all the time; it’s their business and we are experienced in working with them.
Integrated Care Pathways
The lawyer brings you, the experience and expertise to match the insurance company. The lawyer's role traditionaly has been to get you as much compensation as the law allows. However at Ashton KCJ we not only take on the compensation claim but also help you get as well as possible, as quickly as possible through the introduction of integrated care pathways. This involves rehabilitation. Initial care will be provided by the NHS but their resources are not limitless. To get the best care often involves additional funding of resources, which could be:
Therapists – physio therapists, occupational therapists, and speech therapists are all available within the NHS but are a limited recourse even within the hospital. After leaving hospital, there may be a long term need for ongoing therapy, which is not available without funding.
Behavioural rehabilitation – after regaining physical health, and becoming as well as possible, the most important aim is to get home, to family and friends. Brain injuries can drastically change personalities and behaviour, but there are things that can be done if funding is available, which can help.
Vocational rehabilitation – 90% of people out of work for a year, remain out of work long term. This can cause poverty and hardship for those involved. It can be devastating; but it doesn’t have to be like that. We have forged links with employers and services to enable you or your family member to return to work, possibly even in a different capacity.
Compensation
An assessment needs to be carried out of what has been lost, of what is required now and what may be needed in the future. This may involve medical support, medications, equipment, ongoing therapies, special vehicles, adaptation to the home, and assistance at home and work. All these items carry a fee, and will need to be planned and costed carefully. The Court of Protection must be involved in the event that mental capacity is lost. We can help you through the complex process of administering another person's finances. We want to ensure that you can make as many decisions about yourself or your family member's life as is possible.
All this costs money which is where compensation plays a massive part. Your lawyer should be able to ensure your interests, and those of your family member, are taken fully into account. They can also ensure that the best available care and help is provided, to maintain your quality of life, and those around you, to the highest possible degree.
