Constructive Dismissal

Sometimes, as an employee, you may be entitled to resign in response to poor behaviour by your employer, and claim compensation for what is known as constructive dismissal. Although you have resigned, the law recognises that where your employer has treated you in such a way that leaves you with no option but to do so, because it has destroyed the mutual obligation of trust and confidence that exists between you, then this can be treated as a dismissal.

It is often a high-risk strategy to resign with a view to claiming constructive dismissal, however, there are certain circumstances when this is entirely appropriate.
